1. Acceptance of Terms
These Reviewer & Creator Key Terms and Conditions ("Key Terms") govern the request, receipt, and use of complimentary game keys ("Keys") for Guinea Pig Runaway (the "Game"), provided by DWS Interactive ("we", "us", "our"). By requesting and/or accepting a Key, you ("Recipient", "you", "your") agree to be bound by these Key Terms, as well as our general Terms of Service and Privacy Policy. If you do not agree, you must not request or use a Key.
2. Changes to These Terms
We reserve the right to modify or update these Key Terms at any time without prior notice. The most current version will be posted on our website, and your continued use of a Key constitutes acceptance of any changes. It is your responsibility to review these Key Terms periodically.
3. Eligibility
By requesting a Key, you represent and warrant that:
You are a content creator, streamer, journalist, curator, or member of the press requesting the Key for the purpose of reviewing, covering, or creating content about the Game.
You are at least 13 years old (or the minimum age required by your jurisdiction) or have the consent of a parent or legal guardian.
You have the legal capacity and authority to enter into these Key Terms.
Your request and use of the Key does not violate any applicable law, regulation, or platform policy.
4. Grant and Scope of the Key
We grant you a limited, non-exclusive, non-transferable, revocable license to activate and use the Key for the sole purpose of personal evaluation and the creation of editorial or promotional content about the Game.
Keys are provided entirely at our sole discretion. Submitting a request does not entitle you to receive a Key, and we are under no obligation to provide one.
5. Personal Use and Non-Transferability
Keys are issued for your individual use only. You may not sell, resell, trade, auction, gift, sublicense, redistribute, or otherwise transfer a Key to any third party. Keys hold no monetary value and may not be exchanged for cash, credit, or any other consideration.
6. Content Creation
You are permitted to produce videos, livestreams, screenshots, written reviews, and other coverage featuring the Game, and to monetize such content through standard platform features (such as advertising or platform partner programs).
You agree that any coverage will reflect your honest, good-faith opinions and impressions of the Game. You may not misrepresent your relationship with DWS Interactive or imply official endorsement, partnership, or sponsorship unless a separate written agreement exists between us.
7. No Obligation to Create Content
Receipt of a Key does not obligate you to produce coverage of any kind, of any particular nature, or by any particular date. Likewise, we make no guarantee regarding the timing, frequency, or future availability of Keys.
8. Embargo
Unless we explicitly communicate an embargo or review date in writing, no embargo applies, and you are free to publish content as soon as you receive and activate your Key. Where an embargo is specified, you agree not to publish or publicly share any coverage before the stated date and time.
9. Intellectual Property
All content within the Game and related materials, including but not limited to characters, artwork, logos, audio, music, code, and trademarks, is the property of DWS Interactive or its licensors and is protected by applicable intellectual property laws.
Your license to create content does not transfer any ownership of the Game or its assets to you. You may not use our intellectual property outside the scope of creating coverage of the Game, nor create standalone merchandise, derivative products, or other commercial works using our assets without our prior written consent.
10. Prohibited Uses
You agree that you will not:
Sell, share, or distribute the Key or any account credentials associated with it.
Use the Key or the Game to engage in cheating, hacking, reverse engineering, data mining, or distribution of unauthorized modifications, except where expressly permitted by us.
Use the Game or any related materials in a manner that is unlawful, defamatory, infringing, hateful, or otherwise objectionable.
Misrepresent the source, sponsorship, or nature of any content you create.
Attempt to disrupt, exploit, or gain unauthorized access to our systems, services, or the Game's online functionality.
11. Revocation
We reserve the right to deactivate, revoke, or invalidate any Key, without prior notice or liability, that we reasonably believe has been sold, shared, misused, obtained fraudulently, or used in violation of these Key Terms.
12. Disclaimers
The Game and any Keys are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of a Key and the Game is at your sole risk.
13. Limitation of Liability
To the fullest extent permitted by applicable law, DWS Interactive and its affiliates, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your receipt or use of a Key or the Game, even if advised of the possibility of such damages.
14. Indemnification
You agree to indemnify, defend, and hold harmless DWS Interactive and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or connected with your use of a Key, your content, your violation of these Key Terms, or your infringement of any third-party rights.
15. Governing Law and Dispute Resolution
These Key Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions. Any disputes shall first be addressed through good-faith negotiation; if unresolved, they shall be submitted to binding arbitration under the rules of the Istanbul Arbitration Center (ISTAC), or to a court of competent jurisdiction located in Istanbul, Türkiye, as mutually agreed.
16. Termination
We reserve the right to suspend or terminate your access to a Key and any related services, without prior notice or liability, for any reason, including breach of these Key Terms. Upon termination, all rights granted to you under these Key Terms will immediately cease.
17. Miscellaneous
These Key Terms, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and DWS Interactive regarding your request and use of a Key. If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any provision will not constitute a waiver.
